A difficult global economic climate has led investors to seek out yield in emerging and frontier markets, often requiring negotiation with nations that have limited experience in dealing with private counterparties. Tightening public budgets and a spate of high-profile disputes with protectionist governments have set off alarm bells within the investment community. High commodity prices have resulted in a resurgence of resource nationalism. Against this backdrop investors in these markets are increasingly mindful of the importance and implications of contractual risk where there is a public counterparty. Rather than historic concerns about war and civil disturbance, or even straight expropriation, it is the contract-level enforcement and consistency which is increasingly dominating political risk concerns.
