Kate Bennett [More Info]

Kate came to the Bar in 2014 after 16 years in private practice. As a solicitor, her main areas of practice were Insurance Litigation, in particular, Reparation, Personal Injury, Property Damage claims, Insurance Law, Regulatory Crime (Including Health and Safety and RTA prosecutions) and Fatal Accident Inquiries. Kate also has experience of clinical negligence cases.

As a solicitor, Kate was involved in some high profile cases, for example, ICL/Stockline (lead solicitor throughout the four key legal processes which followed: Judicial Review, Criminal Proceedings, ICL Inquiry and the Civil Claims) and Thomson v Dennis Thomson Builders Ltd & Hamilton v Ferguson Transport (Spean Bridge) Ltd [2012] CSIH 52

Kate personally conducted a large number of Sheriff Court proofs, Debates and Appeals as well as appearing in Fatal Accident Inquiries. She also conducted a number of RTA and Health & Safety cases.

 
Craig Connal QC [More Info]
Craig Connal QC is the Course Convener.

He is a Partner who is qualified in Scotland, England and Wales. As a solicitor-advocate in both jurisdictions he has rights of audience in all courts, civil and criminal, up to and including the Supreme Court of the United Kingdom.

Craig has appeared in high profile and complex litigation in a wide variety of courts, inquiries and tribunals. His practice covers an equally wide range of areas, from planning to pensions, insolvency to IP, environmental to employment, regulatory to contracts and all points in between. He has a particular interest in judicial review. He was the first solicitor-advocate in Scotland to be appointed to the rank of Q.C. (Queens Counsel).

He has appeared in the Supreme Court. He sits as an arbitrator and is a NITA (National Institute for Trial Advocacy) accredited trainer in advocacy. He is registered to appear in the DIFC Court, Dubai.

Craig won Solicitor Advocate of the Year category in The Law Society Excellence Awards 2012.

Craig is Vice Chairman (Scotland) BICBA.
 
W.Stuart Gale QC [More Info]
Stuart Gale QC was admitted to the Faculty of Advocates in 1980 having devilled to the Rt Hon Lord Macfadyen, and took silk in 1993. He has an established practice in commercial and public law fields, with particular expertise in town and country planning, land use, oil and gas, and judicial review.

He has acted for major companies in the offshore explore and development fields in inquiries into offshore incidents, and in health and safety and environmental prosecutions. In 2009-10 he acted for the designer MFV Trident in the re-opened formal investigation into her loss in 1974. He has also acted for promoters seeking legislative approval for infrastructure developments, and for developers and planning authorities.

He has appeared in the House of Lords in Ross v Lord Advocate [1986] 1 WLR 1077 (as junior counsel), in City of Edinburgh Council v Secretary of State for Scotland 1997 SC(HL)33 and in Reid v Grainger 2004 SC (HL) 19 (as senior counsel), and in the Supreme Court in Multi-Link Leisure Developments v North Lancashire Council 2011 SLT 184 and Davis v Scottish Commission for the Regulation of Care 2013 UKSC 186.
 
The Hon Lord Kinclaven [More Info]
Lord Kinclaven was appointed a Judge of the Supreme Courts in 2005.

He is a graduate of the University of Edinburgh (LL.B Hons) and was admitted to the Faculty of Advocates in 1978. He was Standing Junior Counsel in Scotland to the Accountant of Court from 1986 to 1989. He served as an Advocate Depute from 1989 to 1992 and was appointed Queen's Counsel in 1991.

Lord Kinclaven became a member of the English Bar (Lincoln's Inn) in 1990. He was a part time Sheriff from 2000. He was a member of the Scottish Legal Aid Board from 1994 to 2002; a member of the Scottish Council of Law Reporting from 2001; a part-time Chairman of the Discipline Committee of the Institute of Chartered Accountants of Scotland from 1994; a part-time Chairman of the Police Appeals Tribunal from 2001; and a member of the Scottish Criminal Cases Review Commission from 2004. He is a Fellow of the Chartered Institute of Arbitrators.
 
George Moore QC [More Info]
George has over 35 years' experience in all aspects of insurance related litigation, but has a particular interest in Court of Session litigation and insurance fraud.

He is qualified as a solicitor advocate and is one of only a handful of civil solicitor advocates to be appointed as a QC in Scotland.


 
Gerry Moynihan QC [More Info]
Gerry practises widely in civil litigation and appears frequently in courts at all levels. He has acted as an arbiter and as chairman of the Police Appeals Tribunal. He acted as clerk to the Inquiry undertaken by Sir Anthony Campbell into the prosecution decisions relating to the murder of Surjit Singh Chhokar as well as being Senior Counsel to the Fingerprint Inquiry.

Lord Tyre was appointed a Judge of the Supreme Courts in May 2010.

Lord Tyre is currently a commercial judge in the Court of Session. He is a member of the Scottish Civil Justice Council and of the Judicial Council for Scotland, and is one of the representatives of the latter Council on the European Network of Councils for the Judiciary. He is also a member of the Board of Trustees of the Academy of European Law in Trier, Germany.
His publications include the CCH Inheritance Tax Reporter, of which he was author and also editor until 2000, and various contributions on taxation to the Stair Memorial Encyclopaedia. He was co-author of Tax For Litigation Lawyers (2000).
 
Michael Upton [More Info]
Michael has extensive experience and expertise in most areas of civil litigation. His main interest lies within the planning law field where he has experience of the whole palette of planning work including appeals, inquiries, enforcement and CPOs.
