RELEASE OF LIABILITY
Whereas PC Connection, Inc. d/b/a Connection, acting through one or more of its affiliates or wholly-owned subsidiaries, including PC Connection Sales Corporation, GovConnection, Inc., MoreDirect, Inc., GlobalServe, Inc., and Softmart (all referred to as “Company”) is sponsoring a Deep Sea Fishing activity, including but not limited to Deep Sea Fishing (the “Activity”), for certain of its officers, employees and guests; and
Whereas, participation in the Activity is voluntary and not required by Company; and Whereas, such Activity has elements of danger and risk outside the control of the Company, and the undersigned officer, employee or guest has been informed of such danger and risk and accepts such danger and risk as part of the Activity; and
Whereas, the undersigned officer, employee or guest understands and agrees that participating in the Activity may include difficult physical activity and that he or she is responsible for obtaining competent medical advice or clearance before undertaking such Activity; and
Whereas, Company is offering the Activity on the condition that the participating officer, employee or guest releases Company from all liability relating to the activity;
NOW, THEREFORE, THE UNDERSIGNED OFFICER, EMPLOYEE OR GUEST HEREBY RELEASES COMPANY AND CO-SPONSOR FROM ALL LIABILITY FOR INJURY, DEATH, DAMAGES AND LOSS ARISING FROM THE ACTIVITY, EXCEPT FOR ACTS OR OMISSIONS THAT CONSTITUTE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, AND THE UNDERSIGNED, AND HIS OR HER HEIRS, EXECUTORS AND REPRESENTATIVES, AGREE TO HOLD COMPANY AND CO-SPONSORS HARMLESS FROM ANY CLAIMS BROUGHT AGAINST THEM ARISING FROM HIS OR HER PARTICIPATION IN THE ACTIVITY, EXCEPT FOR ACTS OR OMISSIONS THAT CONSTITUTE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
Undersigned also acknowledges that he or she is over the age of 18 years.
