Dr Simon Banks
General Manager
Great Barrier Reef Marine Park Authority
Dr Simon Banks is the General Manager, Great Barrier Reef Operations at the Great Barrier Reef Marine Park Authority (GBRMPA). He is responsible for GBRMPA’s field management program, Indigenous partnerships program, Reef HQ Aquarium and GBRMPA’s legal services.
 
Prior to joining GBRMPA Simon was a senior executive in the Commonwealth Department of the Environment responsible for environmental assessments and approvals, and management of the use of Commonwealth environmental water in the Murray Darling Basin. Simon’s previous experience includes working for the NZ Department of Conservation where he was responsible for Marine Protected Areas Policy Implementation, sub Antarctic marine protection and several protected species programs. Simon has worked for the Queensland and NSW state governments on marine park policy implementation.

Simon has over 16 publications related to marine ecology and marine protected area planning and management and has completed a PhD in biological sciences investigating the use of siting algorithms for the protection of representative habitats for intertidal systems.

 
Mr Patrick Bond

After an active career in the Royal Fleet Auxiliary, Patrick Bond spent several years in the offshore supply sector before qualifying as a solicitor with a major UK marine law  firm. He went on to join a leading marine mutual insurer. From the late 1990s Patrick worked independently as a claims and emergency response consultant to the marine industry, working on several major casualties and coordinating litigation defence worldwide before joining Thomas Miller Claims Management as the Claims Director in 2007 and in 2015 Director Head of Legal at Thomas Miller Law. A marine solicitor for over twenty years, he is  an accredited Mediator,  a Member of the Law Society and the Nautical Institute.

 
Captain Jim Cochrane

Recruited in UK by Department of Shipping & Transport (forerunner to AMSA) as Marine Surveyor because of Extra Master’s Certificate, based in Sydney.

Joined Seabridge Australia (container agents for continental lines - Hapag Lloyd, Nedlloyd, Messageries Maritime, & Lloyd Triestino).  Seconded to the position of Australian Co-ordinator of the ANZECS service for ten years.  Final position in Seabridge Australia was  Australian Operations Manager.  Company closed in 1994 so then joined TAFE as a Nautical Lecturer.

Member of Australian Chamber of Shipping (ACOS) Technical Committee for many years and chairman for 5 years.  Represented ACOS as member of AMSA Navaids Committee for 15 years.

Now retired from TAFE but involved in lecturing to Advanced Marine Pilots Courses held at Smartship Australia in Brisbane.  

 
Mr Joel Cockerall
Maritime Specialist

Joel is a maritime specialist with more than 10 years of sea-going experience on a variety of vessels. He specialises in contentious and non-contentious matters concerning offshore oil and gas installations, commercial shipping and international trade.

He joined Clyde & Co after spending 12 years in the Royal Australian Navy (RAN). While in the RAN he was a Maritime Warfare Officer specialising in navigation. He qualified as a Deck Officer in 2004 and then worked overseas in South East Asia and the Middle East. Upon returning to Australia he specialised in navigation and returned to sea as a Second Officer.  In 2009 he was promoted to Executive Officer (Chief Mate) on board naval vessels and has a restricted naval pilots licence for Australian ports.

Joel completed his law degree with first class honours and was awarded the Attorney-General’s Medal.

With extensive maritime experience, Joel is a focal point for Clyde & Co's Australian marine casualty response team.

 
Mr Paul David QC
Eidon Chambers
Paul David QC has over 30 years’ experience in litigation and advisory work. He started his legal career at the Bar in England where he worked for 7 years before joining Russell McVeagh, a leading New Zealand firm. He was a partner at that firm until 2002 when, with others, he founded the litigation specialist firm Wilson Harle. He has been at the independent bar since 2006 and was appointed Queen’s Counsel in 2014.

Paul has appeared as counsel in all New Zealand Courts and in overseas jurisdictions in a wide variety of disputes. He has a broad practice which now centres on contractual and commercial disputes. He has developed specialist practices in both maritime law and sports law and is recognised as a leader in those fields. He is the author of 2 leading texts reflecting his specialist interests – Halsbury’s Laws of New Zealand Maritime Law – Admiralty and A Guide to the World Anti-Doping Code (CUP), with a third edition planned for 2016.

Paul also accepts instructions as an arbitrator and mediator in commercial, maritime and sporting disputes. He is an arbitrator with the Court of Arbitration for Sport.

 
Professor Sarah Derrington

Professor Sarah Derrington is Dean of Law at the University of Queensland and a barrister specialising in maritime and shipping law.

She has published in leading international journals in the field of marine insurance and carriage of goods by sea and, with James M Turner QC of the English Bar, co-authored The Law & Practice of Admiralty Matters, now in its second edition (OUP, 2016). 

Sarah is a Director of the Australian Maritime Safety Authority (AMSA), the Australian Maritime College (AMC), and the Australian National Maritime Museum (ANMM). She is a member of the Commonwealth’s Admiralty Rules Committee, the Chartered Institute of Arbitrators, the Institute of Company Directors, and is a Fellow of the Nautical Institute and of the Australian Academy of Law. She is a former President of MLAANZ.

 
Mr Adrian Duffy QC

Adrian was admitted to the Bar in 1997, having practised for some 14 years as a solicitor, most of which time he was a partner heading up the maritime, transport and aviation area in the Brisbane office of one of the leading firms n Australia. He took silk in 2015.

His practice extends to a broad range of commercial litigation, arbitration and mediation, including Admiralty and maritime law, industrial and employment law, insurance, engineering and construction, mining and resources, trade practices and commercial contracts.

He has served on and chaired many professional committees and delivered a number of papers on a variety of areas of law. He is presently a member of the Professional Conduct Committee of the Queensland Bar.

He is listed in the 2016 edition of Doyle’s Guide as one of the Leading Transport Barristers in Australia and as one of the Leading Employment & WHS Barristers in Queensland.

 
Ms Stacey Fraser

Stacey Fraser is a senior legal advisor to Maritime New Zealand (MNZ), the New Zealand national administration with responsibilities for maritime safety, security and environmental protection. Stacey has worked for MNZ since 2009 and is responsible for providing legal advice on a range of international law and maritime issues including international conventions and maritime incident response.  She has been the Head of the New Zealand delegation to the IOPC Funds meetings since May 2014, and is currently the Chairman of the Executive Committee of the 1992 IOPC Fund. She also regularly attends IMO Committee and Sub-Committee meetings as New Zealand’s representative. Stacey is currently Secretary of the New Zealand Branch of the Maritime Law Association of New Zealand and Australia.
 
Professor Nick Gaskell
Professor of Maritime and Commercial Law

Nick Gaskell is Professor of Maritime and Commercial Law at the Marine and Shipping Law Unit (MASLU) of the TC Beirne School of Law, The University of Queensland. Prior to joining UQ in 2009, Nick worked for some 33 years at the Institute of Maritime Law, University of Southampton. He is a UK qualified barrister, and is an Associate Tenant at Quadrant Chambers (London), one of the leading maritime law sets.  

Nick Gaskell has considerable experience of the negotiation of international maritime law conventions. In particular he participated in the IMO diplomatic conference which resulted in the Athens Convention 2002, and was a member of the UK delegation. 

He has taught maritime law to governments, practitioners and students within the maritime legal and shipping professions both within Australia and internationally and has authored/edited 7 books, 41 book chapters and over 50 articles.  
 
Ms Rosemary Gibson

Rosemary Gibson is an Associate in Thynne + Macartney's Maritime & Transport Group.  Rosemary has experience in commercial litigation, dispute resolution and insurance law including marine insurance, heavy road transport insurance, life insurance and personal injury.  Rosemary has a special interest in maritime and shipping law, and currently acts for a range of international P&I Clubs as well as local insurers. Her expertise includes advising clients in relation to cargo and wharf damage, ship groundings, charter party disputes, marine insurance and marine pollution. 

Rosemary holds a Bachelor of Laws (Hons) and a Bachelor of Arts from the University of Queensland, and a Master of Laws in marine and shipping law.

 
Ms Isabelle Guaran

Isabelle joined MIAL in July of 2016 in the role of Industry Employee Relations Manager.

She holds a BA Laws and a BA in Creative Writing. In her role at MIAL she provides advice to members on employee and workforce issues, and works with government and industry stakeholders on employee relations issues impacting the maritime industry.

In her previous role Isabelle worked in the transport public sector in NSW and has industrial relations experience in the state and federal systems. She has been the IR lead on large scale strategic reforms in the NSW rail industry and has been responsible for policy development, strategic planning, dispute resolution and negotiation.

He practises in commercial law with particular emphasis on shipping, international trade, corporations and insolvency law.

Neil Hiller has over 35 years in Marine insurance – working in claimes, broking, risk management & underwriting in London, South Africa, and the last 13 years in Australia.

More recently, General Manager at QBE jointly heading up their Marin Specialty Risks division & in April this year launched “Austbrokers Hiller Marine’ – a specialist broking & risk management business focusing on supply chaing and marine risks.

A fellow of ANZIF and the Chartered Insurance Institute, a Chartered Insurance Borker, has a MSc in risk managemtns, a former Senior Examiner of the Chartered Insurance Institute, an active member of the Sydney Marine Discussion Group and has been very involved in the foundation of the new Institute of Marine Insurance Practitioners.  In 2016 Nile sat on the MLAANZ sub-committee that reviewd the Marine Insurance Act following the passing of the UK Insurance Act.

Assoc Professor Kate Lewins

Kate Lewins is an Associate Professor at the School of Law, Murdoch University and an Academic Fellow of the Centre of Maritime Law, National University of Singapore. She teaches and researches in the areas of carriage of passengers by sea, admiralty, carriage of goods by sea, and insurance law. Kate is the Moot Director of the International Maritime Law Arbitration Moot (recently hosted by RMIT in Melbourne) and a former editor of the Australian and New Zealand Maritime Law Journal. Kate is the author of monograph titled International Carriage of Passengers by Sea, published by Sweet & Maxwell in September 2016.

Captain Listrup is a Master Mariner with over 30 years of sea going experience including 10 years in command.  Peter has considerable and extensive experience in the operations and management of marine simulators. Prior to his role as Director of Smartship Australia Peter was the Vice President of the Star Cruises Ship Simulator in Malaysia.

Lauren advises on legal issues in Australia, New Zealand and the Pacific Islands as well as advising on matters of international law such as international maritime jurisdiction. Lauren is a passionate human rights advocate and is committed to a diverse and inclusive legal profession.
 
Mr Toby Stone

Toby Stone works for the Australian Maritime Safety Authority (AMSA) and as General Manager looks after all the response functions of AMSA including Search and Rescue, Pollution, Salvage and Intervention.

Toby Stone has also been appointed as the Maritime Emergency Response Commander (MERCOM).

MERCOM is the national decision maker responsible for the management of responses to maritime casualties with intervention powers to take such measures as may be necessary to prevent, mitigate or eliminate a risk of significant pollution, incurring the power to direct a port to release a tug to provide emergency assistance to a vessel at risk, or designate a place of refuge for a ship in emergency situations that present a risk of significant pollution.

Toby Stone previously worked in the United Kingdom as Head of Counter Pollution and Salvage for the Maritime and Coastguard Agency. Prior to this he spent a number of years at sea as a Deck Officer with BP Shipping serving on a variety of tonnage. He then joined the Maritime and Coastguard Agency.

He has been involved in and attended a variety of maritime shipping casualties including the Braer, Sea Empress, Ever Decent and MSC Napoli. In addition, he attended the Erika and Prestige disasters in France and Spain. He also attended the Rena container ship incident advising the New Zealand Government. In his role as MERCOM who has been involved in a number of high profile, high consequence incidents that have been successfully resolved prior to any actual pollution.

He is also a member of AMSA’s Executive team and is the current Security Executive.

 
Mr Maurice Thompson

Maurice Thompson leads Clyde & Co's Australian maritime law group and has more than 22 years' experience advising clients from the shipping, commodities, insurance, mining and oil & gas industries domestically and internationally on contentious and non-contentious maritime law matters.

He is regularly instructed by the world's preeminent global commodity trading companies in respect of sale of goods, marine insurance, charterparty, carriage of goods and other related matters. 

He has a large maritime practice relating to the offshore oil & gas sector with particular expertise in respect of the JPDA and has been on the Emergency Oil Spill Response Team as principal external legal counsel for oil & gas majors both in Australasia and in the Middle East. 

Maurice has formal specialist maritime law qualifications from Tulane University and the University of Cape Town to compliment his Australian legal qualifications. He is admitted in England and Wales and worked in China and the Middle East for six years.
