Snap-on Tools Apprentice of the Year 2016 Terms and Conditions

Snap-on Tools Australia (ABN 55 010 793 683), 80 Holbeche Road, Arndell Park, NSW, 2148 (“the Promoter”).

  1. Information about how to enter, how to claim prizes and details of the prices form part of these terms and conditions of entry. Entry into the Snap-on Tools Apprentice of the Year (“the Promotion”) is deemed an acceptance of these terms and conditions of entry.
  1. Promotion dates:
  2. The Promotion commences at 08:00:01 (AEST) on Friday, 1st July 2016 and closes at 17:00:00 (AEST) on Monday, 29th August 2016.
  3. The major prize and category winners will be selected on Monday, 17th October 2016.
  4. The Promoter will make all reasonable efforts to contact the major prize and category winners. Winners will be contacted by the Promoter via telephone in the first instance (otherwise via email), by Friday, 11th November 2016.
  5. Winners will be given until Friday, 25th November 2016 in which to reply and vailidate their acceptance. If the winning entrant has not been verified or validated to the Promoter’s satisfaction then that entrant will be ineligible and deemed invalid, and the applicable prize re-awarded.

 

  1. To enter the competition, entrants must:
    1. Complete and submit Snap-On Tools Apprentice of the Year entry form at www.snapontools.com.au during the Promotion period.
    2. Accept the terms and conditions of the Promotion.
    3. Be a resident of Australia or New Zealand.
    4. Not be an employee of the Promoter, or agencies or companies associated with the Promoter, or a member of the immediate family of such an employee.
    5. Be a second, third or fourth year apprentice.
    6. Be employed from Wednesday, 1st July 2015 to Friday, 28th October 2016.
    7. Be employed in, and training for one of the following trades:
      1. Automotive
      2. Heavy vehicle
      3. Marine
      4. Aviation
      5. Defence forces
      6. Other (please be able to specify trade, however it is up to the Promoter’s discretion to deem whether your entry is applicable)
    8. Provide references from his/her employer and ensure their availability for interview between Monday, 5th September 2016 and Friday. 23rd September 2016.
    9. Be available for a telephone interview between Monday, 5th September 2016 and Friday. 23rd September 2016.

  2. The Promotion consists of one major prize, and two category prizes.

 

    1. The major prize for Apprentice of the Year consists of one (1) of the below Snap-on Tools prize packs that is available in Red, Green and Orange.

  1. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
  2. If any prize (or part of any prize) is unavailable, for any reason beyond the Promoter’s reasonable control, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification in lieu.

 

  1. Winner selection
    1. Winners will be chosen through a game of skill. A game of skill is a game or competition where the outcome is determined mainly by mental or physical skill, such as submitting an entry form based on your experience, rather than by chance. This definition is derived from State and Territory legislation. The winning entries will be selected by a panel of judges appointed by the Promoter.
    2. All valid entries will be judged in regard to the overall quality of:
      1. Answers provided on the entry form which show the passion and drive entrants show for undertaking their apprenticeship in addition to key achievements and milestones both on the job and outside of work
      2. Answers provided on the entry form in regard to literacy, composition, creative merit and originality
      3. Information gathered through a telephone interview with the entrant
      4. Information gathered through a telephone interview with the entrant’s employer
      5. Information gathered through a telephone interview with the entrant’s teacher
    3. The Promoter’s decision is final and no correspondence will be entered into.
    4. If the winner of the major prize or category prize is under 18 years of age, the prize will be awarded to the winner’s parent or guardian.
  1. Conditions of prize acceptance
    1. Acceptance of the prize is also subject to the relevant prize supplier’s prevailing terms and conditions.
    2. It is a condition of accepting the prize that the winners may be required to sign a legal release or releases in a form determined by the Promoter in its absolute discretion.
    3. Once a winner has been notified, the Promoter will, where applicable, liaise with the winner to determine the preference of the winner (e.g. travel preferences for the major prize), subject to availability. The winning entrants must provide a mailing address upon being notified of their winning entry. Where applicable the prizes will be mailed by registered post. (delivered by Snap-on Franchisee / representative) The Promoter takes no responsibility for the loss of the prizes due to incorrect or imprecise address details being provided, or for any other reasons outside of the Promoter’s control. A prize that is not claimed by the winning entrant and/or is returned by registered post will be deemed to be forfeited.
    4. All additional costs which may be incurred in acceptance and use of the Prizes are the responsibility of the winner.
    5. No compensation will be payable if a winning entrant is unable to use the prize for whatever reason. The Promoter accepts no responsibility if the prize is lost or stolen. Nor will the Promoter be responsible for any loss suffered beyond the control of the Promoter, nor will the winning entrant be entitled to any additional benefits or prizes as a consequence of the loss.

 

  1. Promotional use of entrants
    1. The major prize winner and category winners’ name, company name, apprenticeship details and suburb will be published on www.snapontools.com.au and/or any associated Facebook page once the winner has proved their eligibility to be a winner.
    2. The Promoter may request permission from winning entrants to use their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of publicising this promotion.
  1. Modification of competition    
    1. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  2. Costs associated with entry    
    1. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

 

  1. Ownership of entries
    1. Once submitted, an entry to this competition becomes and remains the property of the Promoter.
  2. Validity of entries & disqualification of entrants
    1. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid.
    2. An entry is deemed to be received at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Entries which are partially or wholly incomplete, inaccurate, false, erroneous, ineligible and incomprehensible or outside the intent of the campaign, will automatically be deemed invalid. Contact details entered incorrectly on the promotional site by an entrant will automatically deem an entry invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.
    3. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any entrant from the promotion if the Promoter reasonably believes that they have attempted, deliberate or otherwise to: (a) tamper with the entry process; (b) submit an entry which is not in accordance with these Terms and Conditions; and/or (c) engage in any unlawful or other improper conduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter in full for those losses, damages and costs payable as a debt due on demand.
  1. Liabilities
    1. Except for any liability that cannot by law be excluded, Snap-on Tools Australia (including its respective officers, employees and agents) will not be responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

 

  1. Modification or cancellation of the promotion
    1. If this promotion is not capable of running as planned for any reason, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion.
  1. Collection of Personal information
    1. Personal information is collected by Snap-on Tools Australia for the purpose of processing and administering this competition. Snap-on Tools Australia may use entrant’s contact information to contact them regarding the competition during the competition period. Snap-on Tools Australia will not keep or store any personal information provided. Snap-on Tools Australia may use winners’ personal information for future promotional opportunities in relation to the Snap-on Tools Apprentice of the Year competition. This may include disclosure to Snap-on Tools Australia’s contracted service providers, prize suppliers assisting with this competition, relevant regulatory authorities, or if required by law. Personal information collected is managed in accordance with Snap-on Tools Australia’s Privacy Policy available at www.snapontools.com.au.
